Understand the critical difference between Islam as a religion and Sharia as a political system. We oppose only the parts of Sharia that conflict with American law and values. We support religious freedom but oppose Sharia as a political system in America.
America is one of the most religiously free nations in the world. The First Amendment protects the right of every person — Muslim, Christian, Jewish, atheist, or any other faith — to believe, worship, and practice their religion privately and in community without government interference.
This article is not an attack on Muslims or Islam as a personal faith. It is a clear-eyed examination of political Sharia — the legal and governmental system derived from Islamic sources — and why it is fundamentally incompatible with American values and the U.S. Constitution.
The Crucial Distinction
Islam as a Religion: Personal beliefs, prayer, fasting, dietary laws (halal), dress, and worship. These are protected by the First Amendment.
Sharia as a Political System: A complete framework of law, governance, criminal justice, family regulation, finance, and social control meant to be imposed on society and the state.
It is the political and legal aspects of Sharia that create irreconcilable conflict with American principles.
How Political Sharia Threatens American Values
Equality Under the Law The U.S. Constitution (14th Amendment) demands equal protection for all citizens regardless of sex or religion. Traditional Sharia law includes:
Women receiving half the inheritance of men
A woman’s testimony counting as half in certain legal cases
Permission for men to have up to four wives
Different legal status for non-Muslims
These rules violate core American commitments to equality and non-discrimination.
Freedom of Religion and Conscience Americans have the absolute right to change their beliefs or leave any religion. In many traditional interpretations of Sharia, apostasy (leaving Islam) is punishable by death. Blasphemy laws also severely restrict criticism of Islam. This directly contradicts the First Amendment’s protection of religious liberty.
Freedom of Speech The United States protects robust debate and even offensive criticism of ideas and religions. Political Sharia often treats criticism of Muhammad or Islam as a serious crime, leading to self-censorship and punishment.
Criminal Justice The 8th Amendment prohibits cruel and unusual punishment. Sharia’s hudud punishments include amputation for theft, flogging for adultery or alcohol consumption, and stoning for certain offenses. These are incompatible with American standards of justice and human dignity.
Governance and Sovereignty The U.S. Constitution is based on “We the People” and popular sovereignty. Political Sharia places Islamic law above all man-made constitutions and democratic decisions. This creates a direct challenge to American self-government.
We Support Religious Freedom — Not Theocracy
Millions of American Muslims live peacefully and enjoy the freedoms America offers. Many came here specifically to escape strict Sharia-based societies. We fully support their right to practice their faith within the boundaries of the Constitution.
The issue arises when political Sharia is introduced through:
Sharia councils handling family disputes (often disadvantaging women)
Demands for religious arbitration that overrides U.S. law
Attempts to apply Sharia principles in American courts
Creation of parallel societies with different rules
The Solution: Constitutional Supremacy
America works best with one law for all — the Constitution of the United States.
States that have passed “American Law for American Courts” legislation are right to ensure that no foreign or religious law can supersede constitutional rights in American courtrooms. This protects everyone, especially women and children who might be pressured under Sharia norms.
Conclusion
Opposing political Sharia is not Islamophobia. It is common sense and constitutional patriotism.
We can and should support Muslims practicing their faith peacefully in America. At the same time, we must firmly reject any political or legal system that undermines the foundational American values of liberty, equality, free speech, and the rule of law.
The Political Side of Sharia is incompatible with the American system. For America to remain the land of the free, we must preserve the supremacy of the U.S. Constitution — for all citizens, now and in the future.
