From State Bans to Federal Action: The Growing Movement to Stop Sharia Law

The United States was founded on the principles of liberty, equality under the law, and the supremacy of the Constitution. Yet, a growing movement across the country is sounding the alarm on efforts to introduce or accommodate Sharia law—a political and legal system derived from certain interpretations of Islamic doctrine—into American life. While we strongly support religious freedom for all Americans, including Muslims practicing their faith privately, we firmly oppose any attempt to establish Sharia as a parallel or overriding political and judicial system that conflicts with our constitutional rights.

The State-Level Awakening

Over the past decade and a half, more than two dozen states have introduced or passed legislation aimed at protecting American courts from foreign or religious laws, including Sharia, that could undermine constitutional protections.

States like Alabama, Arizona, Florida, Kansas, Louisiana, North Carolina, South Dakota, Tennessee, and Texas have taken decisive action. These measures typically prohibit state courts from enforcing or considering Sharia or other foreign laws in ways that violate public policy, due process, or individual rights—particularly those related to gender equality, free speech, and freedom of religion.

Recent examples include Texas Governor Greg Abbott signing legislation to prevent the creation of Sharia-compliant residential compounds, and ongoing efforts in states like Arizona and Oklahoma to strengthen protections against foreign legal influences in family law, contracts, and arbitration.

These state initiatives reflect a grassroots response to real-world cases where Sharia principles have clashed with American values—such as unequal treatment of women in inheritance or divorce, restrictions on apostasy, or punishments incompatible with the Bill of Rights.

The Push for Federal Protection

What began as a state-by-state effort is now gaining momentum at the federal level. In 2025, Senator Tommy Tuberville (R-AL) introduced the No Sharia Act, which prohibits the application of Sharia law in the U.S. where it would violate constitutional rights. Companion legislation in the House, along with the Preserving a Sharia-Free America Act, seeks to restrict immigration benefits for those advocating Sharia as a governing system and reinforce the supremacy of U.S. law.

Congress has also held hearings titled “Sharia-Free America: Why Political Islam & Sharia Law Are Incompatible with the U.S. Constitution,” highlighting how Sharia’s treatment of non-Muslims as second-class citizens, limitations on free speech, and subordination of women directly contradict core American principles.

This federal movement aims to close loopholes, ensure uniform protection across all states, and send a clear message: America welcomes peaceful religious practice but will not allow any ideology to supplant our Constitution.

Religious Freedom vs. Political Ideology

It is essential to distinguish between faith and governance. The First Amendment protects the right of individuals to worship as they choose. However, Sharia, when applied as a comprehensive legal and political system, often includes elements that are incompatible with the Constitution:

  • Inequality: Differential treatment based on gender or religious belief.

  • Supremacy: The notion that Islamic law should override secular law.

  • Restrictions: On free speech (blasphemy rules), apostasy, and personal autonomy.

Supporting religious freedom does not mean endorsing the importation of theocratic legal systems that erode the rights of women, children, or religious minorities. Americans of all backgrounds—Muslim, Christian, Jewish, atheist, and others—benefit when the Constitution remains the supreme law of the land.

The growing movement to stop Sharia law is not about discrimination—it is about preservation. It is about ensuring that future generations inherit a nation governed by liberty, not by any foreign or religious legal code that undermines it. As state actions build momentum and federal legislation advances, the message is clear: We stand for one Constitution, one set of laws, and equal justice for all.
