Today, a growing movement calls for America to formally ban Sharia Law as a political and legal system. This is not an attack on Muslims or Islam as a personal faith. It is a necessary defense of American values against a totalitarian political ideology that is fundamentally incompatible with our Constitution.
Religious Freedom vs. Political Sharia
America proudly defends religious freedom. Muslims, like followers of any other faith, have every right to pray, attend mosque, follow dietary laws, celebrate religious holidays, and live peacefully according to their conscience. This is protected by the First Amendment.
Political Sharia, however, is not mere religion. It is a comprehensive legal, political, and social system derived from Islamic sources that seeks to govern every aspect of life — including public law, criminal justice, family matters, finance, and the state itself.

Direct Conflicts with the US Constitution
Apostasy and Freedom of Religion The First Amendment guarantees the right to change or abandon any religion. Under traditional Sharia, apostasy (leaving Islam) is punishable by death in many classical interpretations. This is a direct violation of religious liberty.
Equal Protection Under the Law The 14th Amendment demands equal treatment regardless of sex or religion. Sharia traditionally assigns women lesser inheritance rights, reduced court testimony value in certain cases, permits polygamy for men, and treats non-Muslims as second-class citizens (dhimmis) subject to special taxes and restrictions. These rules violate core American principles of equality.
Cruel and Unusual Punishments The 8th Amendment prohibits cruel and unusual punishment. Sharia’s hudud punishments include amputation for theft, flogging for adultery or alcohol use, and stoning for certain offenses. These are incompatible with American standards of justice and human dignity.
Freedom of Speech Americans have the right to criticize any idea, including religion. Political Sharia criminalizes “blasphemy” or insults to Islam, often with severe penalties. This suppresses open debate and contradicts the First Amendment.
Supremacy of Government The Constitution derives its authority from “We the People.” Political Sharia places divine Islamic law above man-made constitutions and democratic will. This creates an irreconcilable conflict with American sovereignty.
Why America Must Ban Political Sharia
Several states have already passed or attempted “American Law for American Courts” legislation to prevent foreign or religious law (including Sharia) from overriding constitutional rights in family, contract, or criminal cases. These measures are common-sense protections.
Without clear bans and legal barriers, we risk:
Sharia councils influencing family disputes (often pressuring women into unfair divorces or custody arrangements).
Foreign Sharia-compliant finance gaining footholds.
Parallel societies where constitutional rights are selectively applied.
Gradual erosion of women’s rights, free speech, and equality in communities with high concentrations of Sharia adherents.
Countries that fully implement Sharia — such as Saudi Arabia, Iran, and Afghanistan under Taliban rule — consistently show abysmal records on religious freedom, women’s rights, and minority protections. America should learn from these examples, not import their legal system.
Supporting Muslim Americans While Protecting America
The majority of American Muslims live peacefully and enjoy the freedoms our Constitution provides. Many fled Sharia-governed countries precisely because they wanted to escape its restrictions.
Banning political Sharia protects these individuals as much as it protects all other Americans. It sends a clear message: In America, there is only one law — the Constitution of the United States.
Call to Action
We must:
Pass federal and state laws explicitly prohibiting Sharia or any foreign law from superseding the U.S. Constitution in American courts.
Reject any accommodation of Sharia in public institutions, schools, or government.
Uphold the supremacy of American law in all civil and criminal matters.
Continue to defend genuine religious liberty while firmly opposing theocratic political movements.
